LANTERN TREE MOMENTS, LLC
Participant Agreement, Assumption of Risk, and Release of Liability
September 16–19, 2027 | Big Raven Farm, Spring Grove, Minnesota
This is a binding legal agreement between you and Lantern Tree Moments, LLC ("LTM," "we," or "us") for the retreat taking place September 16–19, 2027 at Big Raven Farm in Spring Grove, Minnesota (the "Retreat"). “Participant,” “you,” and “your” mean the individual accepting this Agreement. “LTM Parties” means LTM and its current and former owners, members, managers, officers, directors, employees, volunteers, agents, independent contractors, presenters, activity providers, affiliates, successors, and assigns. “Venue Parties” means Big Raven Farm and its current and former owners, members, managers, employees, volunteers, agents, independent contractors, affiliates, successors, and assigns. The LTM Parties and Venue Parties are collectively the “Released Parties.” This is a binding legal agreement — please read it in full. By electronically checking the acceptance box during registration, providing the requested emergency-contact information, and submitting your registration, you affirm that you have read, understood, and voluntarily agree to every term of this Agreement. Your electronic acceptance constitutes your signature and has the same force and effect as a handwritten signature.
FIRST.- Eligibility, Health, and Voluntary Participation
By accepting this Agreement, you represent, warrant, and agree that:
You voluntarily choose to participate in the Retreat. You understand that LTM may, but has no duty to, inquire into your health or ability to participate, supervise your activities, or provide assistance.
SECOND.- Activities and Assumption of Risk
Time away like this isn not risk-free. Retreat activities may include walks on farm grounds (which can mean uneven terrain, trip-and-fall risk, and exposure to the weather); crafting session(s) (minor risk from handling craft materials); sensory-based activities using essential oils and fragrances (a possible trigger if you are sensitive); tasting activities (see THIRD.- on food allergies); stretching/yoga session(s) (muscle strain is possible); and lower-key evenings like puzzling and game nights. You should also know that Big Raven Farm has a resident dog who will be around shared spaces, and that bedrooms are on the second and third floors of the home, reachable only by stairs — there is no elevator.
Risks may include, without limitation, slips, trips, falls, collisions, cuts, burns, overexertion, muscle strain, allergic reactions, illness (including communicable illness), exposure to weather, insects, animals, plants, food or beverages, and the acts, omissions, or conduct of other participants or third parties. Risks may arise from the condition or use of the Venue, equipment, supplies, food, transportation arranged independently by you, and activities that are planned, modified, substituted, cancelled, or undertaken informally during the Retreat. Some risks are known, while others are unforeseeable.
By joining the Retreat, you knowingly and voluntarily choosing to take part with full knowledge of the risks above, and you expressly accepting them as your own. You assume all risks of injury, illness, loss, damage, or death arising out of or related to your travel to or from, presence at, or participation in the Retreat, whether known or unknown, inherent, incidental, or otherwise, except to the extent caused by a Released Party’s gross negligence, willful misconduct, or intentional misconduct that may not lawfully be released.
THIRD.- Food Allergies, Sensitivities, and Dietary Requests
Please tell us about any food allergies or sensitivities when you register. Any updates to allergies must be provided to LTM no later than fourteen (14) calendar days before the Retreat. Meals are prepared and served in a shared kitchen and dining space, and while we are mindful of what we know, LTM, the Venue Parties, and any food or catering providers can not guarantee that any meal, ingredient, or prep surface is completely free of allergens — cross-contact is possible. What you choose to eat during the Retreat is your responsibility.
Dietary requests are not guaranteed and do not create a medical, nutritional, or allergen-free obligation. You are solely responsible for reviewing ingredients, making food choices, carrying any medication or emergency treatment you may need, and seeking medical care when appropriate. You must not consume any food or beverage you reasonably believe may pose a risk to you.
FOURTH.- Alcohol, Drugs, Conduct, and Removal
The Retreat is alcohol-free. Illegal drugs and non-prescribed controlled substances aren not permitted either. We ask that you arrive, and stay, sober and clear-headed for the full Retreat. If you appear impaired or unsafe, we may remove you from Retreat activities, and no refund will be given in that case.
You must comply with this Agreement, all safety instructions, Venue rules, and reasonable directions of LTM or Venue personnel. You may not engage in conduct that is unsafe, unlawful, disruptive, harassing, threatening, discriminatory, or likely to interfere with the experience, safety, privacy, or property of any person. LTM may, in its sole discretion, deny admission, limit your participation, require you to leave the Retreat or Venue, or contact emergency services if LTM reasonably believes your condition or conduct presents a safety, health, legal, or operational concern. You remain responsible for your transportation, lodging, and all other costs after removal, and no refund, credit, or other compensation will be due.
FIFTH.- Release of Liability and Covenant Not to Sue
In exchange for being allowed to take part in the Retreat, you — on behalf of yourself and your heirs, executors, assigns, personal representatives, and anyone who may assert a claim through you — release, waive, and discharge the Released Parties from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, or expenses (including claims for personal injury, illness, emotional distress, property damage, or death) that arise out of or relate to your travel to or from, presence at, or participation in the Retreat, to the fullest extent permitted by Minnesota law, including claims arising from the ordinary negligence of any Released Party.
You further covenant not to bring, maintain, or voluntarily assist any claim against a Released Party that is released by this Agreement. This release is intended to be conspicuous, broad, and enforceable to the maximum extent permitted by applicable law, but only as to claims that may lawfully be waived.
This release does not apply to, and does not waive, any claim arising from the gross negligence, willful misconduct, or intentional acts of a Released Party. Nothing in this Agreement limits any right or remedy that cannot be waived under Minnesota law.
SIXTH.- Personal Property and Property Damage
You are responsible for your own personal belongings for the duration of the Retreat. LTM isn not responsible for anything lost, stolen, or damaged at or in connection with the Retreat, except to the extent directly caused by a Released Party’s gross negligence, willful misconduct, or intentional misconduct.
If you cause damage to the property or facilities at the venue, you may be asked to cover the cost of repair, replacement, cleaning, remediation, and related reasonable charges.
SEVENTH.- Transportation
Getting to and from the Retreat — including flights, car rentals, ride shares, etc. — is on you to arrange and manage. LTM isn not responsible for transportation delays, issues, or cancellations, and we won will not offer refunds because of transportation problems. LTM does not provide transportation unless it separately agrees in writing to do so.
EIGHTH.- Lodging and Room Assignments
You may share a bedroom and bathrooms with one or more other participants. We don do not screen or match roommates based on habits or preferences, and we can cannot promise compatibility. Room assignments are made at LTM sole discretion; we can cannot guarantee it, but if you would like to room with someone specific, let us know during registration and we will do our best. LTM may change a room assignment, sleeping arrangement, or accommodation at any time for operational, safety, or other reasonable reasons. No particular room, bed, roommate, bathroom, amenity, or configuration is guaranteed.
NINTH.- Cancellation, Changes, and Force Majeure
You are welcome to cancel your participation at any time. That said, once you have registered and paid, we don do not offer refunds, regardless of when you cancel or the reason. Weather is not a reason for a refund. If conditions affect an outdoor activity, we may adjust, move indoors, substitute, modify, cancel, or reschedule it, without refund or other compensation.
If LTM cancels the entire Retreat for reasons within LTM’s control and does not offer a substantially comparable rescheduled Retreat or credit, LTM’s sole obligation and your exclusive remedy will be a refund of amounts actually paid by you to LTM for the Retreat. LTM is not responsible for any consequential, incidental, indirect, special, or third-party costs, including travel, lodging, meals, insurance, lost wages, or other expenses.
LTM may modify, postpone, relocate, or cancel all or part of the Retreat because of weather, natural disaster, disease outbreak, governmental order, venue unavailability, safety concerns, insufficient participation, supplier failure, or any other circumstance reasonably beyond LTM’s control or that makes performance inadvisable. In that event, LTM may provide a rescheduled date, credit, substitute activity, or refund in its reasonable discretion, except where a refund is required by applicable law. LTM’s decision concerning Retreat operations is final.
TENTH.- Medical Care and Emergency Contact
You authorize LTM and Venue personnel to contact your emergency contact and to summon emergency medical assistance if they reasonably believe it is appropriate. You understand that LTM and Venue personnel are not obligated to provide medical care or transportation and may rely on information you provide. You are responsible for all costs of medical care, emergency transportation, and related services. This authorization does not create any duty for a Released Party.
ELEVENTH.- Photos, Video, and Participant Content
Our photography is intentionally focused on atmosphere, activities, and details, not identifiable photos of your face. Every once in a while, we may capture and want to use a photo or video that does show you; by accepting this Agreement, you grant LTM and Big Raven Farm permission to do that, and to use it on our respective websites, social media, and other marketing materials, without compensation to you.
You grant the Released Parties a perpetual, worldwide, irrevocable, royalty-free right to use, reproduce, edit, publish, display, distribute, and otherwise use photographs, video, audio, likenesses, and statements depicting or made by you in connection with the Retreat, in any media now known or later developed, for lawful promotional, educational, editorial, and business purposes. You waive any right to inspect or approve the finished material and release the Released Parties from claims arising from such authorized use, except as prohibited by law.
We can cannot control what other participants photograph or post on their own — that is outside LTM responsibility. You agree not to photograph, record, publish, or share another participant’s personal information or image in a manner that is unlawful, harassing, or inconsistent with a reasonable request for privacy.
TWELFTH.- Indemnification
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless the Released Parties from and against third-party claims, liabilities, damages, losses, and reasonable attorneys’ fees and costs arising from your breach of this Agreement, your negligence or willful misconduct, your violation of law or Venue rules, or your damage to property. This obligation does not require you to indemnify a Released Party for that party’s gross negligence, willful misconduct, or intentional misconduct.
THIRTEENTH.- Limitation of Liability
To the fullest extent permitted by law, the aggregate liability of the Released Parties for any claim arising out of or related to the Retreat or this Agreement will not exceed the amount actually paid by you to LTM for the Retreat. In no event will any Released Party be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for travel costs, lost profits, lost wages, loss of enjoyment, or other expenses, except where such limitation is prohibited by law.
FOURTEENTH.- Minnesota Law; Venue; Waiver of Jury Trial
This Agreement is governed by the laws of the State of Minnesota. Any dispute arising from this Agreement or the Retreat will be brought exclusively in the state or federal courts located in Minnesota, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you and LTM waive trial by jury in any action or proceeding arising out of or related to this Agreement or the Retreat.
FIFTEENTH.- General Terms
If any part of this Agreement turns out to be unenforceable, the rest of it still stands and the unenforceable provision will be modified and enforced to the minimum extent necessary to make it enforceable while preserving its intent. This Agreement is the whole understanding between you and LTM on everything above, and it replaces any earlier conversations or writings on the same topics.
No waiver by LTM is effective unless in writing and signed by an authorized LTM representative. LTM may assign this Agreement. You may not assign your rights or obligations under this Agreement without LTM’s prior written consent. Section headings are for convenience only and do not limit the meaning of any provision. Provisions that by their nature should survive—including the release, indemnification, limitation of liability, governing-law, venue, and general-terms provisions—survive the Retreat and any termination of your participation.
Acknowledgment and Electronic Signature
I have read this Agreement in full. I understand that by registering for the Retreat, providing an emergency contact, and checking the acknowledgment box during registration, I am giving up certain legal rights, including the right to sue LTM and the other Released Parties for ordinary negligence. I am registering for the Retreat voluntarily and not under duress.
I specifically acknowledge that the release in FIFTH.- is intended to release claims for the ordinary negligence of the Released Parties; that I have had the opportunity to ask questions before accepting this Agreement; and that I intend to be legally bound by it.
